Wheeler, DiUlio & Barnabei brought a class action suit on behalf of Sean and Jaime Rose against Travelers Home and Marine Insurance Company.
The complaint alleged that Travelers was wrongfully denying claims for rot damage based on a separate exclusion for long term seepage/leakage of water despite the policy offering specific coverage for rot damage.
After almost a year of litigation and negotiations between Travelers and Anthony DiUlio, Esq., a Partner of Wheeler, DiUlio & Barnabei, and co-counsel, Ken Grunfeld, Esq. of Golomb & Honik, a settlement agreement was reached.
Under the settlement agreement, in addition to a monetary element, Travelers agreed to a practice change to help prevent this same issue from arising in the future. Travelers agreed to modifications to Travelers’ practices with respect to application of a long-term seepage/leakage exclusion to claims for rot damage.
